In his opening statement, Tacopina told the jury that Rocky has a legal permit to carry firearms in California but prefers to carry a fake gun to avoid hurting anyone. He explained that even though Rocky could carry a real gun, he was concerned about causing harm to himself or others. Regarding the November 2021 incident with Relli, Tacopina claimed Rocky fired the prop gun twice to warn Relli, who was attacking their friend Illijah “A$AP Illz” Ulanga. He suggested that Relli fabricated evidence to extort money from Rocky. Initially, police did not find any shell casings, but Relli provided some when he reported the incident. Tacopina pointed out that the magazine found at Rocky's home had different bullets than those Relli reported. He reminded the jury that prosecutors need to prove beyond a reasonable doubt that Rocky had a real gun since he is charged with assault with a semiautomatic firearm.
